What's the Difference between Separation and Divorce?
A divorce is the legal process of formally ending a marriage, whereas no legal process is required for a couple to be separated.
In order to get divorced, a couple who have been legally married must first be separated for a period of at least 12 months. During this period, the couple remains legally married.
The way a couple separates will be different in every situation, however, most commonly, a couple will live apart during their separation period. Though, this isn’t always the case. Some couples may remain living together throughout their separation period. You and former partner can take care of your child support arrangement privately without Government intervention if you can agree on the circumstances. A financial agreement can be created to outline the terms of your child support arrangement.
APPLY FOR AN ASSESSMENT
The Government can conduct a child support assessment to assess the amount of child support you may need to pay or receive. This will involve you and your former spouse providing information about your financial situations, expenses relating to your children and your earnings.
MAKE A LIMITED CHILD SUPPORT AGREEMENT
A limited child support agreement can be made between you and your former spouse, based on the government assessment. One party may end the agreement after three or more years or it may be ended earlier if you both ask for it to finish.
MAKE A BINDING CHILD SUPPORT AGREEMENT
Similar to a self-management child support arrangement, a binding child support agreement involves the parents agreeing the amount of child support without a government assessment, however paperwork relating to the agreement will need to be submitted to the Government.
COURT-ORDERED CHILD SUPPORT
A court may order child support or child management payments. This may happen in situations where an adult child (a child over the age of 18 years) is financially dependent because of disability.
