In an Australian settlement, the pool generally includes what you both own anywhere in the world: an apartment in Shanghai, a business back home, an offshore account. Both of you must give full, honest disclosure. If a partner is moving money offshore, early advice usually gives you more options. We can also account for a deposit that came from parents or in-laws.

There may still be options for your status after separation; because that’s migration law, we point you to a registered MARA agent. Get advice before you sign anything or move out.

Married in China? You can usually still divorce here
Australia recognises most marriages validly registered overseas, and you can usually apply for divorce here once you meet the residence requirement, and there is no need to return to China. A 婚前协议 signed overseas won’t automatically bind an Australian court; Australia has its own Binding Financial Agreements, which generally require independent legal advice for each person.

How Australian family law differs from China's
Divorce is no-fault: the court doesn’t ask who caused the breakup. Property isn’t split 50/50 by default; the aim is a ‘just and equitable’ outcome. Children come first (best interests of the child). And court is usually the last step. Most matters settle through negotiation or mediation.

How much does a Chinese family lawyer in Melbourne cost?

Other matters are charged by the hour, and we tell you our rates and put an estimate in writing. Family law in Australia is generally not “no win, no fee”, and we would rather you heard that from us early than be surprised later.
Can I speak to a Chinese-speaking lawyer in Mandarin or Cantonese right now?
Yes. We can assist you in Mandarin and Cantonese, so you can explain your situation in your own words and understand every answer without anything being lost in translation.

Will separating affect my visa, PR or citizenship?
It can, and this is one of the most common worries we hear. If your visa or permanent residency is connected to your relationship, separating may affect it. As a general rule, the effect depends on the type of visa and where you are in the process, and your situation may differ from someone else’s.

Will my situation stay private within the Chinese community?
It can, and this is one of the most common worries we hear. If your visa or permanent residency is connected to your relationship, separating may affect it. As a general rule, the effect depends on the type of visa and where you are in the process, and your situation may differ from someone else’s.
Your consultation is private, nothing is shared without your say-so, and you never have to worry about running into someone you know. If it is more comfortable, we can speak by phone or video instead of meeting in person.
What happens to property and money held overseas, like assets in China?
Australian courts can take into account property that you and your partner own overseas, though how it is dealt with depends on the circumstances. That can include property in China, offshore accounts, and business interests held abroad.
As a general rule, both people are expected to give full and honest disclosure of what they own. If you are worried a partner is hiding money overseas or controls all the finances, tell us early. There are legal steps that can help identify and account for those assets. Property is not split in a fixed way here; in general, the court looks for an outcome that is just and equitable in your circumstances, and your situation may differ.
We married in China (or overseas). Can we divorce in Australia?
In most cases, yes. Australia recognises most marriages validly registered in China and other countries, so a wedding held overseas usually does not stop you divorcing here.
What matters is your connection to Australia, such as living here or intending to make Australia your home. As a general rule, you also need to have been separated for about twelve months before you can apply for a divorce, though limited exceptions exist. Every situation is different, so it is worth confirming yours with a lawyer before you file.

Is my prenup or financial agreement valid in Australia?
An agreement signed in China does not automatically apply here. Australian law has its own rules for these arrangements, known as Binding Financial Agreements (BFAs).
As a general rule, to be enforceable in Australia an agreement needs to be in writing and each person needs to have had their own independent legal advice. If you signed a prenup overseas, or you are thinking about one now, we can review it and give you general guidance on where you stand. Your situation may differ, so it is worth having it looked at properly.
How do I choose a Chinese family lawyer in Melbourne who understands our culture?
Look for someone who speaks your language and has genuinely worked with families like yours, not just a translated brochure.
The right lawyer will understand cross-border assets, marriages registered overseas, visa questions, and the role that extended family and reputation can play in these decisions. Do I need a lawyer, or can I represent myself in family court?
You are allowed to represent yourself. Whether that is wise depends on how complex your situation is.
If there are children, overseas assets, a visa concern, or a partner who controls the finances, having a lawyer usually makes a real difference. The Australian system also leans towards sorting things out through agreement and mediation rather than court, which is often faster and keeps your private life out of open court. How can I avoid going to court, especially with cross-cultural issues?
Most family matters in Australia are resolved without a courtroom. Reaching an agreement through negotiation or mediation is often less stressful, and it keeps your private matters out of open court.
