In an Australian settlement, the pool generally includes what you both own anywhere in the world: an apartment in Shanghai, a business back home, an offshore account. Both of you must give full, honest disclosure. If a partner is moving money offshore, early advice usually gives you more options. We can also account for a deposit that came from parents or in-laws.

Married in China? You can usually still divorce here

Australia recognises most marriages validly registered overseas, and you can usually apply for divorce here once you meet the residence requirement, and there is no need to return to China. A 婚前协议 signed overseas won’t automatically bind an Australian court; Australia has its own Binding Financial Agreements, which generally require independent legal advice for each person.

How Australian family law differs from China's

Divorce is no-fault: the court doesn’t ask who caused the breakup. Property isn’t split 50/50 by default; the aim is a ‘just and equitable’ outcome. Children come first (best interests of the child). And court is usually the last step. Most matters settle through negotiation or mediation.

How much does a Chinese family lawyer in Melbourne cost?

Family law in Australia is generally not “no win, no fee”, and we would rather you heard that from us early than be surprised later.

In most cases, yes. Australia recognises most marriages validly registered in China and other countries, so a wedding held overseas usually does not stop you divorcing here.

What matters is your connection to Australia, such as living here or intending to make Australia your home. As a general rule, you also need to have been separated for about twelve months before you can apply for a divorce, though limited exceptions exist. Every situation is different, so it is worth confirming yours with a lawyer before you file.

An agreement signed in China does not automatically apply here. Australian law has its own rules for these arrangements, known as Binding Financial Agreements (BFAs).

As a general rule, to be enforceable in Australia an agreement needs to be in writing and each person needs to have had their own independent legal advice. If you signed a prenup overseas, or you are thinking about one now, we can review it and give you general guidance on where you stand. Your situation may differ, so it is worth having it looked at properly.

Look for someone who speaks your language and has genuinely worked with families like yours, not just a translated brochure.

The right lawyer will understand cross-border assets, marriages registered overseas, visa questions, and the role that extended family and reputation can play in these decisions. It also helps to choose an established firm handled by people who have done this many times, so your matter is in experienced hands. The clearest way to judge is a free first conversation, where you can ask questions and decide if the fit is right.
