As a general rule, a divorce granted in another country is recognised in Australia if it was valid where granted and one of the people had a real connection to that country at the time, usually citizenship, permanent residence, or ordinary residence. Recognition can be refused in limited situations, such as where someone was denied a fair process.

If your overseas divorce is recognised, you’re treated as divorced here: you can remarry, and you generally can’t and don’t need to apply for an Australian divorce. If it isn’t recognised, you may still be considered married here. One thing recognition doesn’t do is sort out your property or children, that’s a separate question.

Recognition turns on connection and fairness. In broad terms, here’s what’s looked at.

A genuine connection

An overseas divorce is generally recognised if, at the time, one of you was a citizen of, permanently lived in, or was ordinarily resident in the country that granted it.

The divorce must have been effective under the law of the country that granted it.
