What relocation means, and who decides

In family law, relocation means moving with a child to a place that makes it much harder for the other parent to spend time with them. An international relocation, moving overseas, is the biggest version of that, and it can’t simply be decided by one parent.

There’s no automatic right to take a child overseas, and no automatic right to stop them either. If parents can’t agree, the court decides on one question above all: the best interests of the child. A parent is always free to move themselves, the real question is whether the child goes too.

Whether you want to go or want to stay put, preparation is everything, and there are real consequences to getting the process wrong.

You need consent or an order

To relocate a child overseas, you generally need the other parent’s agreement or a court order. If you face an imminent move, ask about preventing a departure.

Moving without it can backfire

Taking a child overseas without consent can be treated as wrongful removal, leading to a recovery order or Hague steps, and the child being ordered back.

A strong case is built, not assumed

Whether moving or opposing, the evidence about the child’s life, the reasons and the contact plan is what wins or loses these matters.

Agreement is usually better

A negotiated relocation, recorded in consent orders, gives certainty and spares the child a contested case where that’s possible.
