Will my AHPRA registration be affected by a separation or divorce?
A separation or divorce on its own is not a notifiable matter under the National Law and won’t affect your AHPRA registration. Mandatory notifications are triggered by specific conduct (impairment, sexual misconduct, intoxication at work, significant departure from professional standards), and a relationship breakdown isn’t one of them. Where it gets sensitive is if family law proceedings touch on mental health, addiction or family violence, and we work carefully around those edges from the start.
Valuation looks at practice income, goodwill, plant and equipment, service trust arrangements, partnership equity and any restraint or buy-out terms in your shareholder agreement. Specialist practices are valued differently to GP clinics, and a solo private practice is different again from a partner share in a large group. We work with forensic accountants who actually understand medical practices, not generic business valuers who don’t.
Service trusts, family discretionary trusts and bucket companies are common in medical structures, and they’re some of the most contested assets in family law. The court can treat trust assets as property of the marriage where control sits with you, and trustee resolutions made close to separation get scrutinised. We map control, history and beneficiary entitlements with your accountant so nothing surfaces later as a hidden-assets argument.
Hours don’t determine custody, capacity to parent does. The court looks at what each parent can reasonably offer, and on-call rosters, theatre lists and shift patterns are taken into account in a practical way. We help structure parenting orders that work with rostered weekends, locum cover and unpredictable hours rather than against them, so you stay properly involved in your children’s lives.
All income streams form part of your financial position, including VMO contracts, locum payments, public hospital salary, private billings, research grants and teaching income. Variable and incentive income is usually averaged over a few years, and the court can adjust for genuine workload changes. We make sure income is properly characterised so you aren’t paying spousal maintenance based on a peak year.
Doctors and surgeons work in tight networks where reputation travels fast, especially in specialist colleges and hospital corridors. We default to private dispute resolution (mediation, collaborative law, round-table negotiation) so your matter doesn’t end up on a public court list. Where court is unavoidable, we use the privacy mechanisms available under the Family Law Act and brief counsel who understand discretion is part of the brief.
Super is treated as property and can be split between spouses under a Court Order or Binding Financial Agreement, and for high-income earners with large defined benefit or accumulation balances, the way it’s split matters more than people realise. Income protection and life insurance policies usually stay with the policy holder, but ownership, premiums and beneficiaries should all be reviewed as part of the settlement so nothing is left mis-aligned afterwards.
If you’ve rebuilt assets, expanded your practice or have a new partner moving in, a properly drafted BFA protects what you’ve built and clarifies expectations from day one. It’s especially worth doing when there are children from a previous relationship, a family trust, or a practice you don’t want to revalue and renegotiate a second time. Done properly, a BFA is one of the strongest pieces of protection available.
