Will my AFS Licence or financial adviser authorisation be affected by a divorce?
A divorce on its own won’t affect your AFS Licence, your Authorised Representative status, or your ASIC Financial Adviser Register listing. What can create a problem is something separate, like a bankruptcy, an unmet financial requirement, or a reportable breach. We structure your settlement so it doesn’t push you into territory that triggers a licensing issue or a notifiable matter.
Valuation usually requires a forensic accountant who looks at recurring revenue, client retention, gross margin, principal and staff structure, restraint terms, and any buy-sell agreement with co-owners. Specialist advisory practices are valued differently to risk-only books or accountant-aligned planning firms. We brief valuers who understand AFSL practices specifically, not generalists who treat your business like a corner shop.
Your client book is treated as a recurring revenue stream and is one of the most valuable parts of the practice. Trail commissions, ongoing service fees and annual review revenue all factor into the valuation. We work to structure outcomes so you keep control of your client relationships rather than being forced to sell down or trigger a transfer that affects service obligations.
Vested and unvested entitlements, deferred bonus schemes, partnership equity and earn-outs all need to be put on the balance sheet. Some are property, some are future financial resources, and the distinction matters for how they’re divided. The timing of your separation also matters, because pre-bonus versus post-bonus payment can change what’s on the table, and we make sure that’s accounted for properly.
We default to confidentiality on every matter, and for advisers the discretion bar is higher because trust is the product. We work to resolve matters through mediation, collaborative law and round-table negotiation so nothing ends up on a public court list. If court is unavoidable, we use the privacy mechanisms available under the Family Law Act to limit exposure.
Most asset transfers between spouses under Family Court orders or a Binding Financial Agreement qualify for CGT rollover relief, but the rules for discretionary trusts, companies and SMSFs are tighter than people expect. We coordinate directly with your accountant and tax adviser so the settlement is structured cleanly and doesn’t create a tax problem in the year ahead.
SMSFs are some of the trickiest assets in family law. Both spouses are usually trustees, the assets often include property and illiquid investments, and you may need to split the fund, roll one party out, or buy them out without breaching SIS Act rules. We work with your SMSF specialist accountant to plan the exit cleanly so neither party ends up in breach.
If you’ve rebuilt assets after a separation, started a new advisory business, or have a new partner moving in, a properly drafted BFA is one of the most cost-effective bits of protection you can put in place. It documents what’s separate property, what happens to the practice if things end, and clarifies expectations from day one. Drafted properly it holds up. Drafted off a template, it often doesn’t.
