Two kinds of departure prohibition order

The term gets used for two situations. The first is the one most separated parents worry about: stopping a child being taken out of Australia without consent. A court can order that a child not be removed, require passports to be held, and have the child placed on the Family Law Watchlist, an alert run by the Australian Federal Police covering airports and seaports.

The second is a formal Departure Prohibition Order in the strict sense: an order stopping a person who owes child support from leaving the country, issued by the Child Support Registrar. The ATO has a similar power for tax debts. We act in both situations, urgently when we need to.

In the strict legal sense, a Departure Prohibition Order is about money owed, not children travelling. It’s worth understanding if you’re owed child support, or if you owe it.

What it is

The Child Support Registrar can make a Departure Prohibition Order that stops a person with an unpaid child-support liability from leaving Australia until the debt is dealt with.

Tax debts too

The Australian Taxation Office has a similar power to stop a person leaving while certain tax debts are outstanding.

If one is made against you

You may be able to arrange payment, or apply for a Departure Authorisation Certificate that allows travel in defined circumstances. Get advice early.
