What is a Settled Matter?
It is common for matters to settle between the parties prior to a hearing date. If a matter has settled, the parties or their solicitors are required to inform the Court or Tribunal.
If the matter is listed for a mention, the parties will advise of settlement and the Court or Tribunal will often order the parties to file settlement documents before the next mention date (if settlement documents are not filed on the day).
If settlement documents are filed, the parties are not required to attend the next mention date.
Common forms of settlement documents filed with the Court include terms of settlement, consent orders, notice of discontinuance or consent judgement.
