Alex’s Landmark Cases
Zamir & Zamir (2022) – Achieved a decisive victory on appeal, setting aside the client’s six-month imprisonment sentence for contempt due to fundamental errors of law and the failure of the wife to prove contempt beyond reasonable doubt. The judgment reinforces the strict criminal standard required for contempt findings and the necessity of isolating sanctions where multiple counts are alleged.
Gujic & Arterbury (2024) – Successfully defended an appeal concerning the application of s 79(4) and judicial discretion regarding the valuation of inherited assets and other contributions. The appeal’s dismissal affirmed the trial judge’s findings on the non-application of the Stanford principle and robustly confirmed the finality of property orders where discretion is properly exercised.
Kapanadze & Kapanadze (2024) – Secured a highly successful outcome for the Applicant, achieving a 75% contribution assessment despite the Respondent’s acknowledged majority parenting role. This judgment emphasized the superior weight of pre-relationship and ongoing direct financial contributions in obtaining a highly favourable property division for the client.
